      Joseph Kemp Toole (b. May 12, 1851, Savannah, Missouri - d. March 11, 1929, San Francisco, California) was an American politician from Montana.

      He attended public school in St. Joseph, Missouri, and the Western Military Academy in Newcastle, Kentucky. He moved to Helena, Montana in 1870; studied law and was admitted to the bar in 1871 and commenced practice in Helena. Toole was district attorney of the third judicial district of Montana 1872-1876 and a member of the Montana Territorial House of Representatives 1879 - 1881; member and president of the Territorial council 1881-1883.

      Toole was a delegate to the State constitutional conventions at Helena in 1884 and 1889; elected as a Democrat to the Forty-ninth and Fiftieth Congresses (March 4, 1885 - March 3, 1889); he did not seek renomination in 1888.

      Toole was elected as the first Governor of Montana and served from November 8, 1889, until January 1, 1893. He resumed the practice of law in Helena. Toole was a delegate to the Democratic National Conventions in 1892 and 1904. He was again elected Governor in November 1900; reelected in 1904 and served from January 7, 1901, until April 1, 1908, when he resigned on account of ill health.

      He lived in retirement, dividing his time between his home in Helena and San Francisco, California until his death in 1929, aged 77.

      JOSEPH KEMP TOOLE, the first and fourth governor to serve Montana, was born in Savannah, Missouri on May 12, 1851. His education was attained at the Western Military Institute in Kentucky, where he graduated in 1867. He studied law, was admitted to the bar in 1871, and then established a successful legal career in Helena, Montana. Toole first entered politics in 1872, winning his election to the district attorney’s office, a position he held from 1872 to 1876. He served as a member of the Montana Territorial House of Representatives from 1879 to 1881, and was a member and president of the Territorial Council from 1881 to 1883. He also served as a delegate to the 1884 and 1889 State Constitutional Conventions, and was a member of the U.S. House of Representatives from 1885 to 1889. Toole next secured the Democratic gubernatorial nomination, and was elected the state’s first governor in 1888. He was reelected to a second term in 1905. During his tenure, the state’s civil and criminal codes were formed; and a railroad commission board was established. Due to his declining health, Toole resigned from office on April 1, 1908. Governor Joseph K. Toole passed away on March 11, 1929, and was buried in Resurrection Cemetery in Helena, Montana.

      Joseph Kemp Toole, founding the firm with his brother, Edwin Warren Toole, was a key figure in Montana's early history. Toole was admitted to the bar at the age of twenty in 1871. During Toole's terms as delegate to the 49th and 50th Congress of the United States, he spoke often in favor of statehood for Montana. His efforts were rewarded by the passage of the Enabling Act of 1889, which allowed the people of Montana Territory to form a constitution and state government. Toole was elected the new state's first governor the same year.
